IANAL, but it seems to me the first step should be to obtain an
injunction forbidding SCO from collecting any license fees until they
have established a reasonable certainty that their case has merit.
Barring that, at least ask for an injunction requiring them to place all
such license fees collected into an escrow fund, with the proviso that
such fees cannot be spent until their rights to the code in question are
established and that, should their rights not be upheld, such fees will
be returned to the payors with interest.

Given the time frames involved, injunctive relief seems an appropriate
measure.
